On Oct. 10th the Supreme Court of Canada will hear a case that questions when a fetus is legally considered a human being.

This case has been presented to the Supreme Court in light of Ivana Levkovic's charge, and later acquital, of concealing the dead body of her new born child. Like Motion 312 (voted down last week in Parliament) the Levkovic case centres around the question of when a human life legally begins.
In the case the Ontario Court of Appeal ruled that a fetus becomes a child when it has reached the stage in its development where, in the absence of external interference, it would likely be born alive. As the case now sits before the Supreme Court of our nation this verdict is up for discussion and could be over ruled - perhaps giving unborn children, or just born children, rights that have been evasive for almost 25 years on Canada.
In addition to being confronted with the question of when a baby becomes a legal human being the Levkovic case is bringing to light for Canadians the gap in the legal status quo on laws related to abortion.
The case points out the anomaly that exists in our law due to the fact that s. 223 (definition of when a child becomes a human being) and s. 243 (concealing the body of a child that died before, during or after birth) were written in relationship with s. 251 (the abortion law which was struck down in R. v. Morgentaler in 1988 and has not been replaced).
These laws were supposed to work together. Therefore they are incomplete when one is missing. What all this means is that this case is again shedding light on the fact that Canada has no laws on abortion and needs one. Click here to read the case by the Supreme Court.
Right on the heel's of Motion 312's defeat the Levkovic case is again asking the nation of Canada the question 'when does human life legally begin?'. It seems the conversation will not die. For this we are thankful and we believe this is a direct answer to prayer.
Many believe the Levkovic case may have repercussions on Canadian reproductive law and for this reason it is very important to the ongoing fight for life in Canada.
