To help with any confusion regarding CA SB871 we have uploaded the CHP Guidance letter to our website. The letter is direct guidance from the CHP on the main portions of the law as well as the requirements of the law. Briefly SB871 covers:

Any overlying carrier who utilizes an owner-operator over the required period is required to take responsibility of the owner-operator.
Responsibilities include drug and alcohol testing compliance.
Negative results must be obtained prior to utilizing an owner-operator.
Specific penalties, including suspension for those that do not comply.

ARE YOUR SUB-CONTRACTORS IN COMPLIANCE
If you fall under CA SB871, you are required to verify that your subcontractors are complying with the DOT Regulations. If you do not fall under SB871, depending on the DOT mode you fall under, it still may be a requirement. Even if it is not a requirement, it is good practice to make sure your staff is safe while on a work site by verifying the compliance of your subcontractors drug and alcohol program. DOT DRUG & ALCOHOL HISTORY REQUEST FORM
We are finding that this DOT requirement is being misrepresented as a background check or a background check component and is not being completed or is being completed incorrectly. Drug & Alcohol Testing History is a requirement for all modes and depending on the mode you fall under, the length of the verification varies. When hiring new employees, all modes require employers to request Drug & Alcohol History from all of the previous DOT covered employers of that employee over a required period of time. It is a violation not to request this information or report it.

Many companies are hiring background check companies to request this information and these reports are not being completed correctly. Things to look for when completing or requesting Drug & Alcohol Testing History:

Drug & Alcohol History Requests must be signed by the applicant. This form cannot be combined with any other form, such as a background check release form.
Only one employee can be requested on a form at a time.
History must be requested to and be completed by the DER to the past company for your DOT modes required period.
Never complete a request by phone; you must receive a signed release by the applicant.
Complete requests in a timely manner, fines and penalties apply for not requesting or completing requests.

POSITIVE TEST RESULTS
One of the aspects covered in our Reasonable Suspicion Class for Supervisors is handling a positive result. Many employers are confused on what to do because it may not happen very often. Some of the main things you should have in place or will be required to address after receiving a notice of a positive test are:
* When and how to approach an employee after being notified of the results
* Are you going to rehab and the policy points/requirements associated with rehab.
* SAP referral (must be provided, even if you do not rehab).
* Documentation storage and time frame.
* Reporting on a Drug & Alcohol History Request.
If you have not taken a class in over 3 years and are confident your knowledge in the requirements after a positive result, it's time to take a refresher class. Enroll Now.

REASONABLE SUSPICION TRAINING
Classes continue to fill up fast for our monthly reasonable suspicion training for supervisors class.

NOTE: ALL CLASS DATES ON OUR MOS CAMPUS ARE FILLED UNTIL FEBRUARY 2013.

A reserved seat must be made prior to attending, please do not show up without a reservation; seats will not be available.

BROKER NOTIFICATIONS
It is a requirement under California SB871, to inform all brokers of your compliance in a DOT Random Testing Program. All brokers and those that utilize sub-haulers according to the requirements stated in SB871, are also required to request this information from the driver. If you need to request or provide this information please contact us. We have special form letters for brokers to verify your enrollment and special website logins for brokers to verify your enrollment at any time.

2013 Consortium Enrollment
Re-enrollment fees have been invoiced and are due by November 15th. Once we have received your re-enrollment form and fees, your 2013 packet will be mailed to you.

We now have a NEW consortium pool that covers all fees for a year with one flat rate.
